Many tax laws are so complex that it is generally recommended that you work with a seasoned tax attorney. If you are unsure what the best solution is or even what solutions are available, or if you simply do not have enough time to work directly with the IRS or your state to solve your particular tax case, please contact us directly for a free consultation to get on the right track to solve your tax problem.
Knowledge, Organization, Availability, Personal. You are not just a number in an overworked attorney and paralegal's inventory. All clients at Taxsmith have direct contact with the attorney and can contact her whenever they need to discuss questions about their case. At Taxsmith we are knowledgeable in dealing with IRS and state collection issues. If we cannot help you we will refer you to someone who can.
No large upfront fees or high pressure sales tactics. We are affordable and will meet or beat any other quotes. Every client will receive a free initial consultation so that we can determine what options are available for your particular case.
Flexible Schedule. Weekend and evening appointments are available and all clients can contact us any time day or night ~ unlike large firms that are only available from 9 to 5.
Guaranteed results. We treat people the same way we would want to be treated. If we think that we cannot help you, we will let you know. There are many companies out there that will promise to reduce your debts to “pennies on the dollar.” While there are legitimate IRS programs for taxpayers who cannot pay, only the IRS can determine whether or not you are qualified.
Similarly, you should avoid any company that claims they can stop IRS collection efforts. Many companies state that once a power of attorney is filed all collection activities will stop. This is not true and taxpayers can still be hit with wage garnishments, bank levies and Federal tax liens. Many tax firms have sales representatives who will tell you what you want to hear so that they can gain commission on your sale. These sales people do not have a license at risk, unlike a licensed attorney. At Taxsmith we are here to honestly help you on the right path and we are available to talk to you about your case.

Settling your tax debt
the correct way requires an expert evaluation of your particular issues to
determine the best way to move forward. Dealing with the IRS and state may be
intimidating, stressful and time consuming. Taxsmith is here to relieve you of
those worries and resolve your tax matter. We not only want to eliminate your
current tax problem but also establish a game plan so that you do not become a
repeat client. Taxsmith has the expertise to help you with your unresolved
tax problems. The following are some options that taxpayers have with their tax debt.
|
|
| Tax Return Preparation | |
a You do not have to wait until a tax problem arises to contact Taxsmith. We are here to prepare your tax return(s) before you have a tax problem with the IRS or the state. Staying current on filing your tax returns is one of the most important steps in working with the IRS and the state. Whether you have no other issues with the IRS, you are required to file taxes each year as a citizen in America. Often the IRS will waive this obligation if your income is of a certain type of is below a threshold amount, but even then, filing a tax return can be a good way of obtaining a refund. If you do have back tax debt, then filing new returns and staying current is part of the deal in working with a tax resolution. Many offer in compromises, settlements, and other various deals with the IRS are denied because the taxpayer failed to remain current on their tax filings.
|
|
| Installment Agreements | |
a Most taxpayers cannot pay their debt in full or qualify for an Offer in Compromise.
In these cases the IRS offers installment agreements allowing taxpayers to
make monthly installment payments based on their ability to pay. Taxsmith
professionals will negotiate affordable payment plans based on your budget and
financial profile that will allow you to regain financial control and to avoid
any IRS or state collection activity in the future.
|
|
| Currently
Non-Collectible
|
|
a If
a taxpayer cannot make monthly installment agreement payments and does not
qualify for an Offer in Compromise
the IRS may consider a Currently
Non-Collectible (CNC) status. If a taxpayer is placed in a CNC status the IRS
agrees
that the taxpayer does not have the ability to make any payment on their
back owed debt at this time. If a taxpayer is placed
in the CNC status, the
statute of limitations continues to run and the IRS will not pursue collection
activities. However,
if the taxpayer's financial status
does improve substantially, the IRS can remove the CNC status and request
additional financial information. |
|
| Offer in Compromise | |
a An Offer in Compromise is an agreement between a taxpayer and the IRS that settles
the taxpayer’s tax liabilities for less than the full amount owed. If you
qualify an Offer in Compromise (OIC) is frequently the ideal solution to
resolving your delinquent tax debt. The OIC was created by the IRS in 1992 by Section 1772 of the Tax Code. The two primary
grounds for which an OIC can be successfully negotiated with the IRS are: Doubt
as to Collectibility (e.g., the taxpayer is unable to pay the full burden) or
Doubt as to Liability (e.g., the taxpayer contends that they do not owe the
debt). A very small percentage of taxpayers qualify for an OIC and thus
pre-review of an OIC is an important step before submitting an OIC to the IRS
and it being rejected.

| Penalty
Abatement
|
|
a Abatement
of tax penalties means that the IRS will eliminate certain penalties that
have been assessed to the tax debt if there is reasonable cause. However, the burden of proof to prove reasonable cause lies with the taxpayer. Taxsmith has the
expertise and understanding of what the IRS will accept as a reasonable cause
for the abatement. If we believe that after a review of your case that you have
reasonable cause we will present it in a well-documented format to the IRS for
consideration. |

| Unfiled Tax Returns | ||||||
a The value of having an attorney review your tax returns could save you hundreds if not thousands. We pull your master file directly from the IRS and verify exactly what has been reported as income to the IRS. The IRS will not allow you to get into any type of resolution without having your tax returns completed properly and filed. Having your tax returns prepared is the first step to resolving your tax issues. |
||||||
| Tax Lien | ||||||
a A Federal tax lien is the government’s legal claim against your property when you neglect or fail to pay a tax debt. The lien protects the government’s interest in all your property, including real estate, personal property and financial assets. A Federal tax lien exists after the IRS:
a How a Lien Affects You
a There are many different solutions to getting a tax lien resolved. Please contact us today so that we can review your case and establish a game plan. |
||||||
| Wage Garnishment | ||||||
a One of the most common collections methods the IRS will utilize is a wage garnishment. This occurs when the IRS notifies a taxpayer’s employer of your unpaid tax debt and then requires the employer by law to deduct and send a portion to the IRS to recover the monies that you currently owe. For self-employed taxpayers, the IRS can garnish the business’ accounts receivables. For anyone receiving social security or military retirement benefits are subject to a 15% levy. Wage garnishments remain in effect until either the taxpayer’s debt is paid in full or a resolution is negotiated with the IRS. a The IRS will not stop collection activity with just a wage garnishment and may also issue a bank levy. At Taxsmith we have released numerous wage garnishments and understand the possible embarrassment and strain that any garnishment puts on one’s ability to provide not only for themselves but also their family. Immediately after contracting with Taxsmith we start negotiations with the IRS to release your wage garnishment. Please contact Taxsmith so that we can establish a game plan for your resolution and for releasing your garnishment. |
||||||
| Bank Levy | ||||||
a The worst feeling is when you go to use your bank account and realize that you have no funds available because the IRS has issued a bank levy. If the IRS levies your bank account, your bank must hold funds you have on deposit, up to the amount you owe, for 21 days. After 21 days, the bank must send the money plus interest, if it applies, to the IRS. This holding period allows time for Taxsmith to resolve this issue and get your funds released. The IRS can levy funds from any institution, business, individual or bank account that bears the name of the taxpayer. Our team of tax professionals have stopped and successfully negotiated numerous bank levy releases. |
||||||
| State Taxes | ||||||
a The majority of taxpayers that owe the IRS, usually have a state tax debt issue. State tax agencies tend to be more aggressive in the collection process than the IRS. Each state has its own set of regulations and options for resolving state tax debt. Please contact us today to see if we can help you with your state tax debt issue. |
||||||
| Tax Penalties | ||||||
a What really angers a lot of taxpayers are the additional penalties and interest added on top of the IRS debt. There are so many different penalties that many people find it difficult to decipher what each one means. The two most common penalties are failure to pay and failure to file penalties. What makes matters even worse is that the IRS will charge interest on top of those penalties. While the penalties and interest continue to grow the tax debt continues to grow but there are a range of reasons why the IRS would abate those penalties. |
||||||
| Payroll Tax | ||||||
a Social security and Medicare taxes are more commonly known as payroll taxes or 941 taxes. Employers are required to withhold employment taxes from their employees’ and pay those over to the IRS. An employer is quarterly required to file a form 941, Employer’s Quarterly Federal Tax Return and to annually file a Form 940, Employers’ Annual Federal Unemployment Tax Return if the business has employees. When business owners are unable to meet these obligations, a Trust Fund Tax liability is assessed. The IRS does not budge when this type of tax debt is created and will not allow the trust fund tax to be discharged in bankruptcy no matter what. a The IRS will usually assign a Revenue Officer to collect on payroll tax debt. Revenue Officers will attempt to collect the entire payroll debt and if a business does not correct the issue the Revenue Officer could force the closure of the business and liquidation of the business assets. a Once a business owner is in compliance with payroll tax regulations, Taxsmith will assist the taxpayer in reaching a resolution for the past due payroll liability and help the business become compliant with IRS regulations. |
||||||
| Revenue Officer | ||||||
a If a Revenue Officer has been assigned to your case then you are at the highest level of the IRS collection process. Revenue Officers are by definition “collection officers.” Their objective is to collect the taxes that are owed as quickly as possible and to have the account paid in full. Only when automated methods have failed to collect a tax is the matter assigned to an individual for collection. Any information you give a Revenue Officer may be used against you. You have the right to contact professionals to represent you with your battle against the IRS. Through Taxsmith’s help you can avoid unknowingly providing information that may be detrimental to you. We understand that it can become even more intimidating once a Revenue Officer is assigned to your case and we are here to battle the IRS on your behalf. Once you contract our services the Revenue Officer must deal directly with us instead of you. By contacting Taxsmith you will regain confidence that professional experts are working on your behalf. |

We are so thankful that we found Taxsmith. I'm an over the road truck driver and have always thought I knew what I was doing when it came to my taxes. I didn't even know I was doing things wrong and then the IRS audited me. They said I owed over $30,000 in back taxes! Then they put a levy on my bank account, and I had absolutely no funds at my disposal. These problems were even putting a horrible strain on my wife and marriage, and we were very afraid that our future was ruined... Through a referral, I called and spoke with a tax attorney at Taxsmith. I was actually surprised that Ms. Angie got on the line with me so quickly. Ms. Smith knew exactly what to do to help fix our tax problems. She immediately stopped a levy on my bank account and set up on a feasible payment plan to pay the taxes we owed. She helped us out so that we did not end up in the same position next year. My wife and I don't know where we would be if it wasn't for Taxsmith. As to the fees Taxsmith charged, it was well worth it and we even were able to make smaller monthly payments to take care of their fees as well. We would highly recommend this firm to assist anyone with overwhelming tax problems.
Thanks again,
Kenny Barrett
We love you Taxsmith!!! My sister and I run a home daycare and we absolutely love our jobs and the independence that running our own business brings. Unfortunately, we were doing things very wrong and one day we got a letter from the IRS saying they were going to levy us. They said we owed $22,000 dollars and we did not have that type of money. I was on the verge of a total meltdown and didn't think there was any way out. I finally decided to try and find an attorney to see if they could help us. I came across Taxsmith and called them because it seemed like they really cared about their clients- and they really do! On the very first call they transferred me to Ms. Smith. She calmed my nerves and was so knowledgeable about the tax code and what was happening to us that I knew right away we were going to be ok. Not only was Ms. Smith very professional, but the fees Taxsmith charged are so reasonable. Within no time, Taxsmith was able to work out a payment plan for us to be able to pay and catch up without shutting down our business or the need to sell our cars and other assets. Taxsmith saved our jobs and business.
Sincerely,
Allison and Emily Jones
I felt nothing but shame and sorrow when I was notified by the IRS that I owed over $80,000 in tax debt and my wages were going to be levied if I didn't pay the debt immediately. I am a church leader and I am supposed to set the example with my role and actions. I was so ashamed that I had been doing things wrong that I thought the only way out was to up and leave to avoid the shame of the ordeal. I decided to see if anyone could help because I hear about these tax companies on the radio and see them on TV. I don't really trust those "sounds too good to be true" lines that they advertise, so I dug deep to try and find an attorney that wasn't so big that I would be just another number. That was when I found Taxsmith, and contacted them because they seemed very trustworthy. I spoke with Ms Angie who explained what needed to happen and the fees to get the job done. Not only did she immediately lift the worry from my shoulders, but the cost to fix this problem wasn't nearly as much as I was expecting. She was able to get the levy stopped and save my wages and then arranged for me to make reasonable payments to the IRS and also to Taxsmith. God bless you Taxsmith, I am so fortunate to have found you.
